Article 1 - Definitions
In these terms and conditions, the following definitions apply:
Customer: the party with whom ‘t Struyskommitee enters into an agreement, including both consumers and non-consumers;
General Terms and Conditions: these current General Terms and Conditions of ‘t Struyskommitee.
Consumer: a natural person who is not acting in the course of a profession or business;
Day: calendar day;
Durable medium: any instrument that enables the customer or 't Struyskommitee to store information addressed personally to them in a way that allows for future consultation and unchanged reproduction of the stored information.
'Lappen': the currency used during 't Preuvenemint, which the customer can purchase in the online payment environment prior to 't Preuvenemint and at the cash registers or top-up points during 't Preuvenemint;
't Struyskommitee: the legal entity defined in Article 2 of these terms and conditions;
Agreement: an agreement between 't Struyskommitee and the customer;
PreuveneCard: a payment card that can be topped up with 'lappen' for payments during 't Preuvenemint.

1. These general terms and conditions apply to every offer made by 't Struyskommitee and to every agreement concluded between 't Struyskommitee and the customer, as well as to any subsequent agreements. In particular, but not exclusively, these general terms and conditions also apply to topping up 'lappen' after purchasing a PreuveneCard.
2. Since it is not reasonably possible to make these terms and conditions available to the customer before or at the time of concluding the agreement, except for online purchases, they are available for inspection at 't Struyskommitee at all times—specifically at the 'hoofdwacht' during 't Preuvenemint, and at the aforementioned registered address before and after the event. They are also available for inspection at the cash registers during 't Preuvenemint. Furthermore, the general terms and conditions will be sent to the customer upon first request at the expense of 't Struyskommitee. They are also available at all times at: www.preuvenemint.nl/voorwaarden.
3. In the case of online purchases of 'lappen', the text of these general terms and conditions will be made available to the customer electronically in such a way that it can be easily stored by the customer on a durable medium.
Article 4 - The offer
1. To purchase 'lappen', a customer must possess a valid PreuveneCard. This PreuveneCard can be purchased at the cash registers or top-up points on the Vrijthof (during 't Preuvenemint) or in advance via the online environment.
2. The prices for 'lappen' and the PreuveneCard are determined annually by 't Struyskommitee, included in these general terms and conditions, and communicated both in advance (in the online ordering environment) and during the event (at the cash registers and top-up points).
3. The customer shall pay for the 'lappen' immediately, unless otherwise agreed with 't Struyskommitee. After the payment has been validated by the payment provider or by a board member of 't Struyskommitee, the purchased 'lappen' will be immediately credited to the PreuveneCard as a balance.
4. Refunds for unused 'lappen' can be requested from 8:00 AM on the first Monday after 't Preuvenemint until 11:59 PM on the first Thursday after 't Preuvenemint. This can be done using the online form in the PreuveneCard management environment (preuvenemint.mijnkniponline.nl). The refund fee is 1 lap.
5. Once the customer has submitted the request, the balance will be refunded within 5 working days. Refunds will be made using the same payment method used by the customer, unless the parties agree on a different method of return.
6. 'Lappen' obtained as compensation for work or as consideration in a sponsorship package are excluded from refunds.

8. Data processing:
o Payments are stored exclusively for service purposes and are deleted once everything has been processed.
o Stored data (if applicable) can be viewed online via the aforementioned link (preuvenemint.mijnkniponline.nl).
Article 5 - The agreement
1. The agreement is concluded at the moment the customer accepts an offer from ‘t Struyskommitee in the online payment environment, via the cash registers or top-up points, or otherwise, for example in the form of 'lappen' (tokens) that are part of a sponsorship agreement.
2. If the customer has accepted the offer electronically, ‘t Struyskommitee will immediately confirm receipt of the acceptance of the offer electronically.
3. If the agreement is concluded electronically, ‘t Struyskommitee will take appropriate technical and organizational measures to secure the electronic transfer of data and will ensure a secure web environment. If the customer can pay electronically, ‘t Struyskommitee will also observe appropriate security measures for this purpose.
Article 6 – Terms and conditions
1. The customer shall comply with the house rules. The house rules are as follows:

Dutch law applies to the event grounds, as well as the following house rules:
• It is not permitted to bring your own food and/or drinks onto the event grounds.
• It is not permitted to take glasses, bottles, and/or drinks outside the event grounds.
• It is prohibited for persons under the age of 18 to consume alcoholic beverages on the event grounds. Providing alcohol to a minor is also a punishable offense.
• The so-called PreuveneCard is the only legal means of payment accepted at the participating food and beverage outlets.
• Pets, bicycles, mopeds, scooters, and cars are not permitted on the event grounds. Assistance dogs are permitted, although this is strongly discouraged due to the potential presence of glassware on the floor.
• Visitors may be searched prior to the event, and bags may be inspected. Anyone who does not cooperate may be refused entry. Visitors may also be searched and bags inspected during the event for the possession of unauthorized items. These unauthorized items may be confiscated or destroyed as appropriate.
• It is prohibited to climb stages, tents, structures, fences, or other objects.
• It is prohibited to endanger persons and/or property or to cause damage to persons and/or property.
• Posting posters is not permitted on the event grounds and/or on the fencing placed around the event grounds.
• Distributing leaflets, flyers, and/or trading in goods at the event and in the immediate vicinity is prohibited, unless written permission has been granted by the organization.
• Without a permit and/or permission from the organization, conducting trade and offering services on or in the immediate vicinity of the event grounds is prohibited.
• It is prohibited to wear club clothing or other clothing and expressions that may be perceived as provocative.
• Film, video, and/or audio recordings may be made during the event. By entering the event site, visitors tacitly grant the organization permission to reproduce, publish, and/or exploit video and photo footage. No rights can be derived from this. More information can be found in the privacy statement on the website www.preuvenemint.nl.
• The event grounds will be closed after 02:00. It is prohibited to remain on the event grounds after that time without permission from the organization.
• Upon arrival at the event grounds, everyone must familiarize themselves with the emergency exits to be used in the event of an emergency or threat thereof. Always follow the instructions of the organization, security, police, and other competent authorities.
• Failure to comply with the event house rules or failure to follow instructions from authorized personnel may result in being denied access to the event grounds without prior warning or, if necessary, being handed over to the competent authorities.
• In case of doubt regarding the above, the decision of the event organization is final. In situations not covered by the house rules, the organization will decide.
Article 7 - Complaints procedure
1. Complaints or questions can be directed to info@preuvenemint.nl.
2. Complaints regarding the performance of the agreement must be submitted to ‘t Struyskommitee fully and clearly described within 5 days after the customer has discovered the defects or inaccuracies.
3. Complaints submitted to ‘t Struyskommitee will be answered within 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, ‘t Struyskommitee will respond within the 14-day period with an acknowledgment of receipt and an indication of when the customer can expect a more detailed answer.
4. If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement procedure in Article 5.
5. It is also possible to submit complaints via the European ODR platform (http://ec.europa.eu/odr).
Article 8 – Governing law and disputes
1. Agreements between ‘t Struyskommitee and the customer to which these general terms and conditions apply are governed exclusively by Dutch law. The Vienna Sales Convention does not apply.
2. For non-consumers, the court in Maastricht has exclusive jurisdiction to hear any disputes. In addition to this court, the consumer always has the choice of the legally competent Dutch court.
